Jochem Croon is an aviation lawyer and consultant. He is an acknowledged expert in EU and Dutch aviation law. 

 

His particular emphasis is on regulatory and commercial aviation matters, including air passenger rights, slot-regulation issues, traffic rights and airport infrastructure development. Jochem was General Counsel and Head of Industry Affairs at Transavia for over 12 years.

 

In 2014 he started in private practice, where he introduced the “key counsel” concept of providing outsourced legal and regulatory advice and solutions to airlines, airports and other parties operational in aviation. Clients benefit from his broad legal expertise, coupled with his practical know-how.

 

Jochem is a speaker at several aviation industry conferences worldwide and author of articles on air law- and aviation matters for newspapers and professional journals.

During over 12 years of executive responsibility as General Counsel and Head of Industry Affairs of a low cost leisure airline (Transavia), the founder of Croon Aviation Lawyers (Jochem Croon) has dealt first-hand with numerous complex legal situations related to different areas of law. As an acknowledged expert in Dutch and EU aviation law, he has been a front-runner on developing new corporate structures, legal solutions and/or defenses for the European aviation industry.

Experience 

  • Management of litigation and set up of litigation strategy for commercial airlines on many different legal areas (such as regulatory, commercial law, competition law, consumer law, and claims handling) for various courts (including the Dutch Supreme court) and Authorities relevant for aviation (such as Slot coordination, The Dutch competition and market authority, The Dutch CAA/Inspectorate);

  • Guidance on- and implementation of EU law for commercial airlines;

  • Negotiations with governments, enforcement bodies and (aviation) authorities on licenses, agreements, permits, air traffic rights and upcoming new- or amended legislation;

  • Establishment of two new airlines. Architecting and execution of its company and governance structure, both corporate and contractual. Negotiation with shareholders, managing tax rulings and governmental licenses and permits;

  • Successfully representing an EU airline in 2019 before the European Court of Justice regarding referred prejudicial questions on passenger rights in correlation with the EU package travel directive;

  • Victorious for a Spanish carrier at the Dutch Council of State (the highest Administrative Court) in a dispute against the Dutch CAA inspectorate (ILT) on passenger rights enforcement;

  • Representing and defending a regional airport against the Dutch CAA inspectorate (ILT) on its infrastructure development and ICAO-based airport licensing;

  • Representing commercial airlines in the airport slot allocation process and subsequent administrative- and civil law proceedings;

  • Representing and advising various operators (commercial and special purpose operators) on aircraft purchase and leasing;

  • Assisting and advising an aircraft manufacturer on aircraft purchase and lease transactions involving the Dutch jurisdiction;

  • Advising and representing low cost carrier on base closure.
